Terms Of Service


By using any services provided by Jolly Works Web Hosting, hereinafter referred to as ‘Jolly Works Hosting’ You agree:

  • Not to violate the laws, regulations, ordinances or other such requirements of any applicable Federal, State or local government.
  • Not to transmit any unsolicited commercial or bulk email, not to be engaged in any activity known or considered to be spamming or Mail Bombing.
  • Not to make any illegal communication to any Newsgroup, Mailing List, Chat Facility, or another Internet Forum.
  • Not to make, attempt or allow any unauthorized access to Jolly Works Hosting website, servers, your own hosting account or the account of any other customers of Jolly Works Hosting.
  • Not to allow any remote code execution of malicious software through the hosting account provided by Jolly Works Hosting.
  • Not to cause denial of service attacks, port scans or other endangering and invasive procedures against Jolly Works Hosting servers and facilities or the servers and facilities of other network hosts or Internet users.
  • Not to forge the signature or other identifying mark or code of any other person or engage in any activity to attempt to deceive other persons regarding the true identity of the User.
  • Not to use Jolly Works Hosting services to host any website, other content, links or advertisements of websites that: infringe any copyright, trademark, patent, trade secret, or other proprietary rights of any third party information; contain nudity, pornography or other content deemed adult related; profess hatred for particular social, ethnical, religious or other group; contain viruses, Trojan horses, worms, time bombs, corrupted files, or any other similar software or programs that may damage the operation of a computer or a person’s property; contain warez; contain any kind of proxy server or other traffic relaying programs; promote money making schemes, multi-level marketing or similar activities; contain lottery, gambling, casino; contain torrent trackers, torrent Portals or similar software; violent or encouraging violence.
  • Not to upload unacceptable material which includes: IRC bots, warez, image, file storage, mirror, or banner-ad services, topsites, streaming, Escrow, High-Yield Interest Programs (HYIP) or related sites, investment sites (FOREX, E-Gold Exchange, etc), bitcoin miners, sale of any controlled substances without providing proof of appropriate permit(s) in advance, AutoSurf sites, Bank Debentures, Bank Debenture Trading Programs, Prime Banks Programs, lottery sites, muds / rpg’s, hate sites, hacking focused sites/archives/programs, or sites promoting illegal activities, IP Scanners, Brute Force Programs, Mail Bombers and Spam Scripts.
  • Not to engage in or to instigate actions that cause harm to Jolly Works Hosting or other customers. Such actions include, but are not limited to, actions resulting in blacklisting any of Our IPs by the any online spam database, actions resulting in DDOS attacks for any servers, etc. Jolly Works Hosting reserves the right to refuse service to anyone upon Our discretion. Any material that in Jolly Works Hosting judgment, is either obscene or threatening is strictly prohibited and will be removed from Jolly Works Hosting servers immediately with or without prior notice and may lead to possible warning, suspension or immediate account termination with no refund. You agree that We have the sole right to decide what constitutes a violation of the acceptable policy use described above as well as what is the appropriate severity of any corrective action to be applied. In the event that a violation of Our Acceptable Use Policy is found, Jolly Works Hosting will take corrective action upon our own discretion and will notify You. Jolly Works Hosting decision in such case is binding and final, and cannot be a subject of a further change. Jolly Works Hosting cannot and shall not be liable for any loss or damage arising from Our measures against actions causing harm to Jolly Works Hosting or any other third party. We have the right to terminate each and any hosting account that has been suspended for any reason for more than 14 calendar days after the suspension date, unless You has taken corrective measures to remove the initial suspension threat or violation. Any backup copies of the hosting account will be permanently deleted upon termination and no refund will be due. Jolly Works Hosting will not be liable for any loss or damages in such cases.
  • Not to violate the Ryan Haight Online Pharmacy Consumer Protection Act of 2008 or similar legislation, or promote, encourage or engage in the sale or distribution of prescription medication without a valid prescription.

At its discretion, Jolly Works Hosting can remove any content we determine to be prohibited by this agreement or our Terms and Conditions. No backups will be kept of removed content.

You agree to indemnify and hold harmless Jolly Works Hosting from any claims resulting from the use of our services.


Jolly Works Hosting refuses to tolerate any approach to the sending of Unsolicited Commercial Email (UCE) or SPAM through our network and services. Customers of Jolly Works Hosting may not use or permit others to use our network, including our third party networks, to partake in UCE or SPAM distribution. Customers of Jolly Works Hosting may not host or permit hosting of sites or information that is advertised by UCE or SPAM sent from other servers or networks.

Users who maintain email lists, or send emails to more than 10 recipients at a time, or send more than 1,000 emails in a 30-day period must maintain complete and accurate records of all consents and opt-ins and provide such records to Jolly Works Hosting upon its request and allow any party sent email to remove itself automatically and permanently. If a user cannot provide positive and verifiable proof of such consents and opt-ins, Jolly Works Hosting will consider the mass mailing to be unsolicited and take appropriate action to ensure the quality of our network, including our third party networks.

Other prohibited activities related to email include, without limitation, the following: (i) Use of Jolly Works Hosting for the receipt of replies to unsolicited mass e-mail; (ii) Forgery of e-mail headers (“spoofing”); (iii) Spamming via third-party proxy, aggregation of proxy lists, or installation of proxy mailing software; (iv) Configuration of any server to accept and process third-party messages for sending without verified user identification and authentication (open-relay mailers); (v) Hosting web pages advertised within “spam e-mail” sent from another network (“spamvertising”); (vi) Hosting web pages or providing services that support bulk emailers or SPAM; (vii) Any other unsolicited bulk messages, postings, or transmissions through media such as weblog posts, IRC/chat room messages, guestbook entries, HTTP referrer log entries, USENET posts, pop-up messages, instant messages, or SMS messages; (viii) configuring or altering a server in such a way as to defeat remote anti-SPAM filters such as trying to send emails out multiple IP addresses on the same server, or using invalid or recently registered domain names to mask the true identity of your emails; (ix) use of any email address on a mailing list that was not opt-in verified by the same IP address and domain used to send outbound emails.

SPAM Complaint Processing fees – A service fee of $50 per spam complaint will be applied for SPAM complaints that are processed by or sent to Jolly Works Hosting as a result of violations of these Terms of Service. A service fee of $125/hour will apply for investigation and corrective work performed by Jolly Works Hosting to resolve SPAM violations.

IP Blacklisting Removal fees – If, as a result of a Customer’s actions, Jolly Works Hosting’s mail servers or IP address ranges are placed on email black hole lists or other mail filtering software system list, Jolly Works Hosting shall charge Customer $250 upfront and $125 per hour thereafter for any necessary investigation and corrective work.


Jolly Works Hosting may, at any time, audit systems for any data/activity showing potential policy violations. If any terms or conditions are failed to be followed, it will result in grounds for service suspension or deactivation. Jolly Works Hosting reserves the right to remove any account or service without prior notice. If Jolly Works Hosting deactivates your service or account(s) for violating policy, you will forfeit your rights to a refund. No refunds for advance payments on deactivated accounts. Serious offenses may cause immediate deactivation WITHOUT WARNING.

Warnings: The Jolly Works Hosting Abuse Dept makes an attempt to contact the client, via email, when the first sign of a possible violation is noted. These alerts are a courtesy. Responses to such alerts are required within 24 hours. If an alert is received from any Jolly Works Hosting staff member, the client is responsible for acknowledging his/her understanding and citing any action planned or taken, within 24 hours of the notice. Failure to do so may lead to suspension and will require a FIFTY DOLLARS ($50.00 USD) fee for reactivation. Repeated failure to do so may result in termination.

Note: It is extremely important to ensure that the email address on record with the Jolly Works Hosting Client Portal is valid. This is the address used for abuse notifications and warnings.


Without limiting other remedies, Jolly Works Hosting or its affiliates may limit, suspend, or terminate your use of Jolly Works Hosting Products and Services, prohibit access to Jolly Works Hosting’s website, remove hosted content such as emails and website data, and take technical and legal steps to keep you off Jolly Works Hosting’s network if we suspect that you are in breach of these Terms of Service, or are past due by more than 3 days (suspension) or 30 days (termination) on your account balance (subscription payment), causing possible legal liabilities, acting inconsistently with the letter or spirit of our policies, your use of any Product or Service degrades the quality and performance of the Jolly Works Hosting services, if you purchased Jolly Works Hosting Product or Services from an unauthorized reseller, or for other similar reasons, with immediate effect and without recourse to the courts. Jolly Works Hosting shall effect such termination by preventing access to your account and to the Jolly Works Hosting network as well as delete any website content, data, or domain names stored on our network. If you provided a valid email address, Jolly Works Hosting may provide notice to you by email, but is not under obligation to notify you.

All provisions which must survive in order to give effect to their meaning shall survive any expiration or termination of the agreement, including without limitation, all of your representations, warranties and indemnification obligations.

You acknowledge and agree that any termination of the Service under any provision of this Agreement may be effected without prior notice, and agree that Jolly Works Hosting may immediately thereafter delete any and all hosted data, backup files, email files, domain names, account settings, network addresses and any other content within your account that is stored on the Jolly Works Hosting network.


Jolly Works Hosting may or may not require a reactivation fee when a customer account/s is/are suspended. Jolly Works Hosting at it’s discretion may charge FIFTY DOLLARDS ($50.00), and when applicable, to cover any administrative costs associated with the offense/violation, as determined by Jolly Works Hosting.


In any case involving unauthorized parties utilizing a Jolly Works Hosting service for abuse/violations, the client will be responsible for stopping all affected applications, until the source of the problem is found and corrected. Jolly Works Hosting may opt to disable all services until the client can perform such an investigation. If the technical support of Jolly Works Hosting is required for the investigation, the client agrees to compensate Jolly Works Hosting at a rate of $25/hour for such services performed, if such services are not included in the client’s current service package.

In general, the client is responsible for maintaining a secure system. This includes, but is not limited to:

  • Requesting kernel updates (for VPS/Dedicated Server)
  • Applying application patches (for VPS/Dedicated Server)

Additionally, Jolly Works Hosting will not be responsible for securing third-party applications.

The client is expected to monitor his/her system(s) and/or service(s). Resource usage should be maintained within the level outlined in the service contract. Abuse caused by end-users or unauthorized parties may increase resource usage and it should be noted that overage fees may apply.

Certain clients, such as those with fully managed VPS/Dedicated Server support services, may be entitled to a higher level of support than those clients with only basic VPS/Dedicated Server management included with their service(s). The above unauthorized usage responsibilities may differ for such clientele. Further details of technical support provided can be found in the Jolly Works Hosting Managed Services Definition and Backup Policy.


Server Resource Provision. Your use of the server resources shall not endanger the capacity and operation of the shared server.

The decision to upgrade shall rest solely with Jolly Works Hosting and shall be made at its reasonable discretion.

For all Shared and Reseller  account packages:

  • No account should use more than 25% of its CPU limit consistently for more than 30 minutes. Otherwise, if the account consistently uses 25% or more CPU, an upgrade to the next available hosting plan will be required;
  • Running bots, proxy scripts, rapid leech scripts, torrent related scripts, chatting or chat room scripts, PTC (Paid-to-click) site scripts, mail-bombers or spam scripts, topsites scripts, auto-blog scripts, and plugins is strictly prohibited
  • Running stand-alone, unattached server side processes/daemons is strictly prohibited
  • Running any type of web spider/indexer (Google Cash / Ad Spy) is strictly prohibited
  • Running cron scripts with intervals of less than 5 minutes, or setting up more than 5 simultaneous cron jobs is strictly prohibited
  • Running of public file exchange services is strictly prohibited
  • Using your hosting account for the purpose of personal cloud storage, and backup/archive storage is strictly prohibited

For all Cloud VPS and Cloud VPS Reseller  account packages:

  • Running of public file exchange services is strictly prohibited
  • Running bots, proxy scripts, rapid leech scripts, torrent related scripts, chatting or chat room scripts, PTC (Paid-to-click) site scripts, mail-bombers or spam scripts, topsites scripts, auto-blog scripts, and plugins is strictly prohibited
  • Using your hosting account for the purpose of personal cloud storage, and backup/archive storage is strictly prohibited

Jolly Works Hosting technical support engineers may use the following tools at our discretion to identify the use of system resources:

  • Conventional UNIX system tools, like ‘ps’, ‘top’, ‘iostat’ etc
  • MySQL/PostgreSQL stats reporting features
  • DirectAdmin / cPanel report
  • Resource usage alerts from CSF/LFD server security system

Disk Usage Provision. The content on your website must be linked from an HTML or similarly coded web page with all content is freely available to the public. Your website must consist of web pages of a standard design, essentially HTML-based text and graphics. Your hosting account should consist mostly of HTML and PHP files.

The number of inodes employed by one hosting account on shared and reseller servers must not exceed the following limits:

Downloadable files, media, databases must comply with the following limitations:

  • A maximum of 10GB of a shared hosting account can be allocated to music, video or other multimedia files including but not limited to .aac, .avi, .mp3, .mp4, .mpeg, .jpg, .png, .gif files;
  • A maximum of 10GB of a shared hosting account can be allocated to any archive and disk image files containing the complete contents and structure of a data storage medium;
  • A maximum of 10GB of a shared hosting account can be allocated to databases and database dumps including but not limited to .sql files;
  • A maximum of 10GB of a shared hosting account can be allocated to Executable files and all other files which are the result of compiling a program.

Any user whose account/server employs the higher burstable resources on a consistent basis shall agree to upgrade it to a package with higher resource availability.

Under its sole discretion, Jolly Works Hosting reserves the right to determine any kind of unfair or inappropriate usage of any content which may result in immediate account suspension or upgrade to a package with higher resource availability. The decision to upgrade shall rest solely with Jolly Works Hosting and shall be made at its reasonable discretion.

Use of Email Services. You should use email and other related services in full compliance with the terms below:

  • For Shared Hosting accounts, email storage shall not exceed the 10GB limit.
  • For IMAP/POP3 mailboxes, You may perform up to 100 email checks per hour.
  • For POP3, You may perform up to 10 concurrent connections to email system per IP address on Shared and Reseller servers, and up to 20 concurrent connections to email system per IP address on Business and Email servers.
  • For IMAP, You may perform up to 30 concurrent connections to email system per IP address on Shared, Reseller, Business and Email servers.
  • For SMTP, You may perform up to 100 concurrent connections to email system on Shared, Reseller, Business and Email servers. This limit applies to the whole server.

Jolly Works Hosting may, at its sole discretion, limit the volume of email messages You can deliver through our services. Jolly Works Hosting may limit email volume by queuing Your email messages internally, or by temporarily rejecting requests to send email through our services. Jolly Works Hosting may block any message You attempt to submit using our services, for any reason whatsoever, with or without notifying You of such blocking. Under no circumstances will Jolly Works Hosting be liable to You or any other party for any indirect, special, economic or consequential damages (including without limitation lost profits) arising out of email blocking or queuing.

Upgrade to VPS. Each Virtual hosting account can be upgraded to a VPS (Virtual Private Server). The upgrade is performed by Jolly Works Hosting after You have paid the first month’s fee. The fee depends on the VPS type chosen by You and is non-refundable. Prorate amount for unused time of the shared hosting account will not be refunded, it will be added to Your account balance in the event of upgrade to VPS. Once the account is transferred to the VPS the Virtual hosting account is terminated and the new VPS account use is governed by the “Acceptable Use Policy for VPS accounts” of this Agreement accordingly.

IPv4 Address Usage Policy. Due to the exhaustion of the IPv4 address space, we actively conserve IP address space by limiting the IP addresses each web hosting account can use.

Shared hosting accounts may each use only 1 IP address.

Reseller hosting accounts may use up to 4 IP addresses. The number of IPs that are included and the account may use up to are indicated in the plan specification.

The IP address limit is a per account, not a per customer basis. Customers may hold multiple accounts to get access to additional IP addresses. We strongly urge customers to only use IP addresses for essential use and we do require justification for usage.


Jolly Works Hosting may disconnect any idle connection to the network.

Average timeouts are:

  • FTP – 300 seconds
  • Dial-Up – 10-15 minutes
  • Telnet/SSH – 30 minutes

The Jolly Works Hosting Support team takes great lengths to provide polite, prompt and excellent customer service at all times. For the safety and protection of our staff and their families we have a zero tolerance policy in regards to abuse of our staff. You may not threaten, abuse, shout at, swear at, insult, use foul and rude words, or otherwise disrespect our staff during any form of business communication including, but not limited to in person, telephone, live chat, fax, postal mail, Email, forum post, blog post, instant messenger, or ticket response. Violations of this aspect of the Terms of Service and as well as Jolly Works Hosting’s Support Scope is subject to account termination without warning. If such a termination takes place no refund will be given.

Examples of such activity include, but are not limited to:

  • Verbal abuse – cursing, yelling, threatening, using fould and rude words, etc…
  • Ongoing disregard for warnings or notices
  • Consistent mistakes/errors/changes causing unnecessary workload
  • Consistent support request which is beyond the Jolly Works Hosting Techinical Support Scope
  • Posting unfair, biased, and unprofessional review or rating for Jolly Works Hosting
  • Spamming Jolly Works Hosting email addresses, ticket systems, contact (landline and mobile) numbers, SMS gateway, and servers
  • Continuous involvement in flood/DDOS activity, hacked services, or other ongoing non-permitted usage
  • Consistent late payments or responses
  • Issuing a chargeback or bouncing a payment
  • Continuous activation of problematic end-users
  • Activity which affects the service(s) of other Jolly Works Hosting clientele

Technical Support Scope

Jolly Works Hosting Technical Support Scope includes:

  • Technical server support (installation of server modules, server software, etc)
  • Troubleshooting server conflicts (timeout warnings, unaccessible control panel, unresponsive server, etc)
  • Installation help for scripts included in our Softaculous App Installer

Jolly Works Hosting Technical Support Scope excludes (but not limited to):

  • Installation of customer software/script which otherwise could not be installed by our Softaculous app installer
  • Troubleshooting website malfunction such as errors on (but not limited to): incompatibilities on PHP/Apache version, programming error, security breaches, security vulnerabilities, licensing, etc.
  • Modifying customer’s website design, codes, etc.



All renewals made with Jolly Works Hosting entitles the customer to consume the entire renewal period, no credits and refund will be given*.

To cancel or elect not to renew any Product or Service the Customer must submit a cancellation request via the Jolly Works Hosting Client Portal (currently at https://clientportal.jollyworkshosting.com/clients). This must submitted at least seven (7) calendar days prior to expiration of the current renewal term. To insure the privacy and security of both the Customer and Jolly Works Hosting, cancellation must be completed via the Jolly Works Hosting Client Portal only. Requests for cancellation via e-mail, telephone, fax, physical mail, helpdesk or any other means will not be processed.

No refunds will be given, beyond the 30-day moneyback guarantee, for late cancellations. Cancellations requests made seven (7) or less days prior to expiration of current renewal term require that the current service invoice be paid. Account credits, including credits given by Jolly Works Hosting as adjustments, funds added by clients via the billing system, or any other situation are non-refundable and can only be used toward payment of Jolly Works Hosting services.

Please take note that email address with domain of @jollyworkshosting.com is the only accredited email address which will inform you about the progress of your order. [email protected] and [email protected] are also used in case of emergencies and mail server breakdown. Other email address will not be honored by Jolly Works Hosting.

Renewal after a cancellation and/or non-renewal has happened voids any and all of refund eligibility.

You agree to pay Jolly Works Hosting for Products and Services without deduction, or delay for any reason. At any time, Jolly Works Hosting may require you to pay a deposit or increase an existing deposit as a condition of providing Services. You authorize Jolly Works Hosting to investigate your credit history at any time and to share credit information about you with credit reporting agencies. Payment of all charges is overdue within three (3) days after the date of invoice, in U.S. currency. Invoices are issued seven (7) days prior to subscription renewal dates (if you bill on the 15th of the month, an invoice is generated on the 8th of the month and must be paid in full by the 15th of the month). Past due accounts that receive payments will have those payments applied to the oldest past due invoices first. Failure to pay any invoice may place the account into default, and could lead to suspension of all services until the account is paid and current. You will be responsible for reimbursing Jolly Works Hosting for all costs (including reasonable attorney fees) associated with collecting delinquent or dishonored payments. Accounts not paid in full within three (3) days of the invoice due date may be suspended, or terminated and a reconnection late fee of TWENTY FIVE DOLLARS ($25) may be applied for each service in the overdue invoice. Accounts not paid in full within thirty (30) days of the invoice due date may be terminated and any past due invoices turned over to our collections service with an additional collections fee of SEVENTY NINE DOLLARS ($79) will be applied in addition to any past due balance and/or late fees.

Payments sent via Western Union and Cebuana Lhuilier Pera Padala must meet the minimum transaction amount of Php 1,000.00. Otherwise a Php 100.00 additional fee is required to be added to your total invoice amount to cover our personnel’s transportation allowance. All fees, and surcharges for Money Transfers shall be shouldered by the customer and should not be deducted from the total amount to be sent.


Each of Jolly Works Hosting’s managed Shared, Reseller, WordPress Hosting Starter, VPS and Dedicated Server packages carry a 30-day limited money back guarantee on them. If you are not completely satisfied with our services within the first 30 days of your service, you will be given a full* refund of the contract amount. Remember, no refund shall be given to any account

  • Suspended due to TOS violation
  • Under the limitations below

Extended Policy Limitations

    • Domain Name Registrations, Site Builders, SSL Certificates, Email Hosting, Add-ons, WHMCS, cPanel licenses, Fantastico licenses, Softaculous licenses, Hourly administration, and full management plan are not eligible for refunds
    • VPS and VPS Reseller packages are eligible only for a prorated refund
    • Customers who availed the Free Domain included in their package/s voids any and all money-back guarantees
    • All discounted and promotional package/s and service/s (Shared, Reseller, VPS, VPS Reseller, and Dedicated server), is/are eligible for a fifty percent (50%) refund amount only
    • All renewed package/s or service/s, regardless of the billing cycle, is/are not eligible for refund
    • Account credits, including credits given by Jolly Works Hosting as adjustments, funds added by clients via the billing system, or any other situation are non-refundable and can only be used toward payment of services
    • All approved refunds shall be released back to the client’s original payment method when they made the transaction. For offline payments, (Bank deposit, GCash, Smart Money, and Money Transfer), refund shall be transferred to the client’s nominated Philippine bank account (subject to transaction fees deduction).
    • All approved refunds to be released via 2CheckOut or Paypal that is beyond 48 hours after approval will be subject to transaction fees deduction of 4.5% + 0.45 USD.

Customers who will purchase at least one (1) year contract of any Shared Hosting (except “Starter” package) or Reseller Hosting package is entitled to receive one (1) free domain name (new registration/transfer) of choice.

Customers who will avail the Free Domain included in their package/s VOIDS any and all Money-Back guarantees.

5. Terms of the agreement
These terms will begin upon your signup with the affiliate program and will end when your affiliate account is terminated. The terms of this agreement may be modified by us at any time. If any modification to the terms is unnacceptable to you, your only choice is to terminate your affiliate account. Your continuing participation in the program will constitute your acceptance of any change.

6. Signup Bonuses / Credits
Upon signing up with our program, you may or may not receive signup bonuses or credits to your affiliate account. These can amount to some form of cash equivalent. These signup bonuses or credits will only be paid out when you have reached the minimum payout amount designated by our Affiliate Program. You cannot redeem these credits for anything else other than what they are, and will not be dispersed until you have generated enough commissions that is equal or greater than the minimum payout amount. If you do not generate any commissions at all within a period of 1 year, our company reserves the right to revoke and cancel any signup bonuses credited to your affiliate account due to lack of performance.

7. Liability
We will not be liable for indirect or accidental damages (loss of revenue, commissions) due to affiliate tracking failures, loss of database files, and any results of “intents of harm” to the program or our website. We do not make any expressed or implied warranties with respect to the affiliate program and/or products sold at this site. We make no claim that the operation of the affiliate program and our website will be error-free and we will not be liable for any interruptions or errors. We will be responsible for providing all necessary information to allow you to make appropriate Link from Your Site to Our Site. We will be solely responsible for processing every order application for Jolly Works Hosting products or services placed by a customer following a Link from Your Site, for tracking the number and amount of sales generated by the Link from Your Site, and for providing information to you regarding commission payments.

8. Eligiblity and Commissions of Products and Services

All Monthly and Yearly-paid Shared Hosting plans, Reseller Hosting, VPS, and Dedicated Servers are all eligible for referral commissions.

  • 5% ONE-TIME Commission applies to all VPS and Dedicated Server referrals

  • $1 ONE-TIME Commission applies to WordPress Hosting Stater referrals

Additional add-ons, domains, digital certificates, email hosting, site builders, and ALL packages currently in promotion or discount are not eligible for earning comissions with Jolly Works Hosting Affiliate.

10. Payments
Jolly Works Hosting reserves the right to modify the commission value of a sold product/service at its absolute discretion to decide not to pay any Commission to you if we believe that any referral has been made in violation of its technical guidelines, due to referral/customer fraud, or due to referral/customer contract cancellation. It is the Affiliate’s sole and absolute duty to follow precisely this Agreement and its guidelines at all times.

Jolly Works Hosting is under no obligation whatsoever to pay any Commission to any Affiliate who does not strictly follow this Terms and Agreements. Jolly Works Hosting’s determination of the commissions due shall be dispositive.
